Terms & Conditions

Welcome to Pixel Hover. By engaging our services, you agree to the following terms. We believe in total transparency to ensure a seamless creative partnership.

1. Scope of Services & Pricing

  • Modifications: Pixel Hover reserves the right to adjust pricing, packages, and service offerings at any time. New rates apply to all new contracts; however, existing active projects will be honored at their original quoted price.

  • Project Kickoff: Work begins only upon receipt of the initial payment. Delays in information or assets provided by the client will result in a corresponding delay in project timelines.

  • Dormant Projects: If we do not receive feedback or communication for 30 days, the project is placed on HOLD. After 180 days of inactivity, the project is considered CLOSED, and any remaining balance is forfeited.

2. Payment & Renewal Policy

  • Late Payments: Technical support is revoked 7 days past the due date. At 14 days, website services are suspended. After 30 days of non-payment, all data and files will be permanently deleted from our systems.

  • Reactivation: A fee of Rs 5,000/- applies to restart a suspended project or account.

  • Chargebacks: Any credit card chargebacks will result in immediate termination of services and permanent deletion of data.

3. Intellectual Property & Ownership

To maintain the integrity of our custom builds and SaaS infrastructure, ownership is defined as follows:

  • Client Ownership: You own your brand logo (if provided), specific text content you authored, and photography you provided.

  • Pixel Hover Ownership: We retain ownership of the Source Code, CMS (Content Management System), Database Structures, and Visual Design Frameworks.

  • Licensing: Pixel Hover grants you a perpetual license to use the website as long as it is hosted on our secure servers. We do not provide raw source code, MySQL files, or Admin Panel technology for external migration.

4. Hosting & Security

  • Access: To ensure the security of our network and protect our clients from malware, Web Hosting Server Credentials (CPanel/FTP) are not shared.

  • Third-Party Software: Clients may not install external plugins or scripts without written approval. Unauthorized installations that lead to security vulnerabilities will result in immediate account termination.

  • Backups: While we perform weekly server restoration backups, clients are responsible for maintaining their own local copies of their website content.

5. Prohibited Use & Spam Policy

  • Zero Tolerance: We have a zero-tolerance policy for SPAM, UCE (Unsolicited Commercial Email), or illegal activities.

  • Penalties: Violation of our spam policy results in a Rs 5,000/- fine and account termination.

  • Illegal Content: Use of our services for pornography, copyright infringement, or malicious hacking is strictly prohibited and will be reported to the authorities.

6. Support & Maintenance

  • Channel: Support is provided exclusively via email at support@pixelhover.com.

  • Scope: We support our core platform and infrastructure. We do not provide free support for third-party scripts, software bugs from external vendors, or day-to-day administrative tasks like user management.

7. Limitation of Liability

Pixel Hover is not liable for any loss of data, system downtime, or loss of profits resulting from server unavailability. Our maximum liability in any scenario is limited to the termination of the service and a refund of the most recent service month (if applicable).

8. Refunds & Cancellations

  • No Refunds: Due to the custom nature of web design and immediate resource allocation, all payments are non-refundable.

  • Cancellations: Once an order is placed and processing has begun, it cannot be cancelled or refunded.

9. Governing Law

Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Jharkhand, India.


What I Improved:

  1. Readability: Used bullet points and bold headers so clients can actually find the info they need.

  2. Branding: Replaced “Webclick” with Pixel Hover and updated the tone to match a “Modern Agency” feel.

  3. Clarity on Ownership: This is the most sensitive part of your terms. I made it very clear that you own the engine (CMS/Code) while they own the fuel (Content/Photos).

  4. Security Focus: Framed the “No CPanel” rule as a security benefit for the client rather than a restriction.
